Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the AliveYet mobile application and related services (the "Service") operated by AliveYet ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. Service Description

AliveYet is a personal safety check-in application designed to help users confirm their well-being through daily check-ins. When signed-in users fail to check in within a predefined period, the system will automatically send email notifications to their pre-designated emergency contacts.

Important Disclaimer: AliveYet is NOT an emergency response service. It is a notification tool. In case of an actual emergency, please contact your local emergency services immediately.

1.1 Guest Mode vs. Signed-in Users

You understand and agree that you are solely responsible for ensuring that the emergency contact information you provide is accurate and that you have obtained their consent to receive notifications from AliveYet. AliveYet is not responsible for any consequences arising from your provision of inaccurate or unauthorized contact information.

4. Subscriptions and Payments (for VIP features)

Certain features of the Service may be offered on a subscription basis ("VIP Membership"). VIP features include: more emergency contacts (up to 10), tiered notifications (Day 1/3/7), complete check-in history, and more.

You agree not to use the Service for any unlawful purpose or in any way that might harm, abuse, or harass any other person. You agree not to:

The Service and its original content, features, and functionality are and will remain the exclusive property of AliveYet and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our Service may contain links to third-party websites or services that are not owned or controlled by AliveYet. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

9. Limitation of Liability

In no event shall AliveYet, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
