Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the AliveYet mobile application and related services (the "Service") operated by AliveYet ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. Service Description

AliveYet is a personal safety check-in application designed to help users confirm their well-being through daily check-ins. When signed-in users fail to check in within a predefined period, the system will automatically send email notifications to their pre-designated emergency contacts.

Important Disclaimer: AliveYet is NOT an emergency response service. It is a notification tool. In case of an actual emergency, please contact your local emergency services immediately.

1.1 Guest Mode vs. Signed-in Users

The Service supports two usage modes:

• Guest Mode: You can experience the app's basic features without creating an account, including daily check-ins, adding emergency contacts (stored locally on your device only), and local check-in reminders. However, please note that emergency contacts cannot receive email notifications in guest mode, as the server cannot identify you or your contact information.
• Signed-in Users: After creating an account and signing in, your check-in status and contact information will be synced to the server. The server will regularly check your check-in status and automatically send email notifications to emergency contacts when you miss a check-in. This is the only way to get complete safety protection.

We strongly recommend creating an account and signing in to ensure your contacts can be notified in case of emergency.

2. User Accounts

While you can use guest mode to experience some features, creating an account allows you to get the complete service experience:

• You must be at least 13 years of age to use this Service. Users under 13 require parental or guardian consent and supervision.
• You are responsible for maintaining the accuracy and confidentiality of your account information. If you use email/password authentication, you are responsible for keeping your password secure. If you use Apple Sign In, you are responsible for maintaining the security of your Apple ID.
• You are responsible for all activities that occur under your account.
• You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
• Local data created in guest mode (such as emergency contacts) can be synced to the server after signing in.

3. Emergency Contacts

You understand and agree that you are solely responsible for ensuring that the emergency contact information you provide is accurate and that you have obtained their consent to receive notifications from AliveYet. AliveYet is not responsible for any consequences arising from your provision of inaccurate or unauthorized contact information.

4. Subscriptions and Payments (for VIP features)

Certain features of the Service may be offered on a subscription basis ("VIP Membership"). VIP features include: more emergency contacts (up to 10), tiered notifications (Day 1/3/7), complete check-in history, and more.

• Billing: Payment will be charged to your Apple ID account at the confirmation of purchase. Subscription prices are as displayed on the App Store purchase screen.
• Automatic Renewal: Your subscription will automatically renew unless you cancel it at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
• Managing Subscriptions: You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase, or through Settings > [Your Name] > Subscriptions on your iOS device.
• Fee Changes: AliveYet, in its sole discretion, may modify subscription fees. Any fee change will become effective at the end of your then-current billing cycle. You will be notified of any price changes in advance.
• Cross-device Usage: Since your subscription is tied to your Apple ID, you can enjoy VIP benefits on all devices using the same Apple ID, but you need to sign in to your AliveYet account on each device.

5. Acceptable Use Policy

You agree not to use the Service for any unlawful purpose or in any way that might harm, abuse, or harass any other person. You agree not to:

• Impersonate any person or entity.
• Interfere with or disrupt the Service or servers/networks connected to the Service.
• Attempt to gain unauthorized access to any portion of the Service.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of AliveYet and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

7. Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by AliveYet. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

9. Limitation of Liability

In no event shall AliveYet, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
